제 1조 (목적 | Purpose)

본 약관은 디자이노블 주식회사(이하 ‘회사’라 합니다)가 제공하는 인공지능(AI) 기반 서비스 디자이노블 AI 서비스(이하 ‘본 서비스’라 합니다)의 이용과 관련하여, 회사와 이용자 간의 권리, 의무 및 책임 사항을 규정하는 것을 목적으로 합니다.
This agreement aims to define the rights, obligations, and responsibilities between Designovel Inc. (hereinafter referred to as "the Company") and users concerning the use of its AI-based service, Designovel AI Service (hereinafter referred to as "the Service").

제 2조 (용어의 정의 | Definitions)

본 약관에서 사용하는 주요 용어는 다음과 같이 정의됩니다.
The terms used in this agreement are defined as follows:

1. ‘사용자 데이터’ (User Data): 이용자가 본 서비스를 이용하며 입력한 데이터(질의, 텍스트, 이미지, 음성, 영상 파일 등)와 그에 따라 생성된 출력(검색 결과, 분석 자료, 이미지 등)을 의미합니다.
   ‘User Data’ refers to the input provided by the user (e.g., text, images, audio, video files) and the output generated by the Service (e.g., search results, analysis data, or content).
   
2. ‘서비스 기능’ (Service Features): 회사가 본 서비스에 포함하거나 추가로 제공하는 모든 기능, 도구 및 업데이트를 의미합니다.
   ‘Service Features’ refers to all functions, tools, and updates included in or additionally provided by the Service.
   

제 3조 (서비스 이용 계약의 성립 및 효력 | Service Agreement)

1. 본 서비스의 이용계약은 이용자가 약관에 동의하고 서비스 이용을 신청한 후, 회사가 이를 승인함으로써 성립됩니다.
   The Service Agreement is established when the user agrees to the terms, applies for the Service, and the Company approves it.
   
2. 회사는 아래 사유가 발생하는 경우 신청을 거부하거나 계약을 해지할 수 있습니다.
   The Company may reject or terminate the agreement under the following conditions:
   
   • 만 19세 미만이거나 실명 인증이 완료되지 않은 경우
     (Users are under 19 years old or fail to verify their identity)
     
   • 허위 정보로 신청하거나 비정상적인 방식으로 접근한 경우
     (Applications with false information or abnormal access methods)
     

제 4조 (약관의 개정 | Amendment of Terms)

1. 회사는 약관을 개정할 수 있으며, 개정 사항은 적용일 7일 전(불리한 내용의 경우 30일 전)까지 공지합니다.
   The Company may revise the terms, and changes will be announced 7 days prior to application (30 days for unfavorable changes).
   
2. 이용자는 개정 약관에 동의하지 않을 경우 계약을 해지할 수 있습니다.
   Users may terminate the agreement if they do not agree to the revised terms.
   

제 5조 (서비스 사용권 및 권리 | User Rights and Ownership)

1. 이용자는 본 약관에 따라 서비스 사용에 대한 개인적이고 양도 불가능한 권한을 부여받습니다.
   Users are granted personal and non-transferable rights to use the Service under these terms.
   
2. 서비스와 관련된 모든 지식재산권 및 콘텐츠 권리는 회사에 속하며, 이용자는 본 약관에 명시된 권한 이외의 권리를 취득하지 않습니다.
   All intellectual property rights related to the Service belong to the Company, and users acquire no rights beyond those explicitly stated in this agreement.
   

제 6조 (서비스 이용 제한 | Prohibited Usage)

1. 이용자는 서비스 사용 시 다음의 행위를 금지합니다.
   Users are prohibited from engaging in the following actions while using the Service:
   
   • 저작권, 상표권 등 타인의 지식재산권을 침해하는 행위
     (Infringement of intellectual property rights such as copyrights or trademarks)
     
   • 법령에 위반되거나 범죄를 조장하는 콘텐츠 생성
     (Creating content that violates laws or promotes criminal activity)
     
   • 타인의 개인정보나 민감 정보를 입력하거나 공유하는 행위
     (Inputting or sharing personal or sensitive information of others)
     
   • 자동화된 수단을 이용해 서비스에 비정상적으로 접근하는 행위
     (Using automated means for abnormal access to the Service)
     
2. 위반 사항이 발견되면 회사는 이용자의 서비스 이용 제한, 사용자 데이터 삭 제 등의 조치를 취할 수 있습니다. Upon detecting violations, the Company may restrict Service usage or delete user data.
   

제 7조 (서비스 기능 및 신규 기능 | Service Features and Updates)

1. 회사는 본 서비스의 효율성과 사용자 경험을 개선하기 위해 새로운 기능 및 업데이트를 제공할 수 있습니다.
   The Company may introduce new features and updates to improve the efficiency and user experience of the Service.
   
2. 새로운 기능이 제공될 경우, 관련 사용 가이드와 제한 사항을 사전에 공지합니다.
   When new features are introduced, their usage guidelines and limitations will be announced in advance.
   

제 8조 (서비스 데이터 관리 | Data Management)

1. 회사는 사용자 데이터의 저장 기능을 제공하지 않습니다. 다만, 사용자 화면에서 대화 내용을 삭제할 수 있는 기능을 제공합니다.
   The Company does not store user data but provides a feature for users to delete conversation data from their interface.
   
2. 본 서비스가 제3자 서비스를 활용하는 경우, 사용자 데이터가 제3자에게 전달될 수 있으며, 사용자는 이를 수락한 것으로 간주됩니다.
   If the Service uses third-party services, user data may be transmitted to third parties, and users are deemed to have accepted this.
   

제 9조 (서비스 중단 및 변경 | Service Suspension or Modification)

1. 회사는 서비스의 전부 또는 일부를 운영상, 기술상의 이유로 중단하거나 변경할 수 있습니다.
   The Company may suspend or modify all or part of the Service for operational or technical reasons.
   
2. 서비스가 유료로 제공되는 경우에도 회사는 완전성, 무결성, 지속성을 보장하지 않습니다.
   The Company does not guarantee the completeness, integrity, or continuity of the Service, even for paid services.
   

제 10조 (책임의 제한 | Limitation of Liability)

1. 회사는 서비스의 제공 과정에서 발생한 간접적 또는 부수적인 손해에 대해 책임을 지지 않습니다.
   The Company is not liable for indirect or incidental damages arising from the provision of the Service.
   
2. 이용자는 제공된 정보와 출력물을 신중히 검토하고 본인의 책임 하에 사용해야 합니다.
   Users must carefully review and use the provided information and outputs at their own risk.
   

제 11조 (서비스 정책 | Service Policy)

1. 이용자는 본 서비스의 공정한 이용을 보장하며, 회사의 서비스 정책을 준수해야 합니다.
   Users must ensure fair usage of the Service and comply with the Company's policies.
   
2. 악의적 사용(불법적 데이터 입력, 유해 콘텐츠 생성, 서비스 방해 등)은 법적 조치의 대상이 될 수 있습니다.
   Malicious usage (e.g., entering illegal data, generating harmful content, or disrupting the Service) may result in legal action.
   

제 12조 (준거법 및 관할 | Governing Law and Jurisdiction)

본 약관은 대한민국 법을 준거법으로 하며, 분쟁 발생 시 민사소송법에 따라 관할 법원에서 처리합니다.
These terms are governed by the laws of South Korea, and disputes shall be resolved in a court of jurisdiction as per the Civil Procedure Act.

부칙 (Effective Date)

본 약관은 2024년 8월 24일부터 적용됩니다.
These terms take effect from August 24, 2024.
